Terms of Service

These Terms of Service govern your use of the Heirloom iOS application ("Heirloom", "the app", "the service"). By using Heirloom, you agree to these terms. If you do not agree, please do not use the app.

1. The service

Heirloom is an iOS application that restores faded or damaged photographs and composes new wedding portraits using your provided images. The service is provided "as is" and may be updated, changed, or discontinued at any time.

You are responsible for maintaining the security of your account credentials. Do not share your password with others. Notify us immediately at privacy@heirloom.blekhaus.com if you suspect unauthorised access.

We reserve the right to terminate any account that violates these terms, at our sole discretion.

5. Photographs and content

You retain all ownership rights in the photographs you upload and the results generated for you. By using Heirloom, you grant us a limited, temporary licence to process your photographs solely for the purpose of providing the service to you.

This licence ends when we delete your photographs in accordance with our Privacy Policy (within 24 hours of job completion for source photos; when you delete your account for generated results).

We do not claim any ownership in your photographs. We do not use your photographs for training, marketing, or any purpose other than producing the result you requested.

6. Subscriptions and purchases

Free tier: New accounts receive 2 credits at no charge. Each restoration or composition job uses one credit.

Heirloom Membership: Membership is available at $7.99 per month or $39 per year. Membership provides unlimited credits for the duration of the subscription period.

Billing: Subscriptions are billed through the Apple App Store. Your Apple ID account is charged at confirmation of purchase and at the start of each renewal period. You can manage and cancel your subscription at any time via your Apple ID account settings.

Cancellation: If you cancel a subscription, you retain access until the end of the current billing period. No partial refunds are issued for unused time in a billing period.

Refunds: All purchases are processed by Apple. Refund requests are handled by Apple in accordance with their refund policy. In-app credits may be refunded by Heirloom at our discretion where our service fails to produce a usable result — this is separate from any Apple refund process.

Price changes: We reserve the right to change subscription prices. We will notify you at least 30 days before any price increase takes effect. Continued use after that date constitutes acceptance of the new price.

7. Service availability

We aim for high availability but do not guarantee that Heirloom will be uninterrupted or error-free. Processing times vary and are typically 60–180 seconds. We are not liable for delays caused by third-party infrastructure (Apple, OpenAI, Supabase) or force majeure events.

If a job fails and we are unable to produce a usable result after multiple attempts, we will refund the credit used for that job to your account automatically.

8. Intellectual property

The Heirloom name, wordmark, and all original content of the app and website are the property of Heirloom and its developers. You may not reproduce, distribute, or create derivative works from our brand materials without written permission.

9. Disclaimer of warranties

Heirloom is provided "as is" and "as available" without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the results produced will meet any specific quality standard or resemble any particular reference image.

10. Limitation of liability

To the fullest extent permitted by applicable law, Heirloom and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of photographs, data, or profits.

Our total liability to you for any claims arising from your use of Heirloom shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Governing law

These terms are governed by the laws of the jurisdiction in which Heirloom operates. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where prohibited by local consumer protection law.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you via the app or by email at least 14 days before the changes take effect. The current version is always available at heirloom.blekhaus.com/terms. Continued use of Heirloom after that date constitutes acceptance of the revised terms.
